This is not just a short note of lament. While looking for material for my book I came across a series of political cartoon galleries on the Internet., some of these cartoons are brilliant and some of them are truly foolish. But they all have one thing in common. The majority of the cartoonists are unaware of the laws that are designed to protect their creations. They simply don’t care. To protect their creations they are free to ridicule, assault, and murder. By contrast, the inventor of the comic strip, P. C. PLUMER, is credited with establishing a means by which the integrity of the work could be protected. It was established by the first copyright law in the U.S. Under this law it is illegal to do any of the following: • To make a slight alteration in the work • To quote from the work without permission • To publish the work in a form that lacks the artistic merit of the original To be protected, the work must be novel, original, and not in the public domain. By making the rights of the creator clear it will be illegal for any one to exploit the work under these conditions. All of the artists are free to publish the cartoon they create. The danger of publishing without permission is that it makes the content available to anyone else. It could allow someone to copyright the work and use the legal system to become wealthy or famous. The U.S. Supreme Court established the legal principle that “[t]he inventor of the comics strip who was not the creator of the characters or the plot is the person to whom the copyright attaches.” One might think that the question of originality would be a simple one. It is obvious that someone else cannot be the creator of something that has not yet been created. But this is not the case. Some ideas, including those in this book, have been in the public domain for many years. Sometimes the idea may have been patented and protected by law. On the other hand, the idea may have not yet been in existence and the author never put it into practice. However, other ideas were created by others. In this case, they were not the author but instead are considered co-authors. Any owner of such a creation has the right to exploit it under the conditions mentioned above. It will be illegal for someone to exploit a comic strip unless the rules are followed. Of course there are
